Marshae Jones’ attorneys file motion to dismiss indictment

BIRMINGHAM, Ala. (WIAT) — In a filed court document, the attorneys of Marshae Jones, a woman who lost her child during her pregnancy due to a series of events that led to her being shot (see related headline), has released a motion for the indictment to be dismissed. In the document, the defending party of Jones states that the indictment was

…based on a novel legal theory not available or supported under Alabama Law and completely unreasonable and unjust.

The document also stated that the indictment was using a “flawed and twisted rationale” and that “the State of Alabama has charged a new theory of criminal liability that does not lawfully exist.”
