VESTAVIA HILLS, Ala. (WIAT) — UPDATE 9:50 a.m: The Vestavia Hills Police Department has released the following statement about the accidental shooting at Chuck E. Cheese:
On Saturday, April 13, 2019, at 2:50 pm Vestavia Hills Police Department along with the Vestavia Hills Fire Department were dispatched to a call of shots fired with multiple victims at 500 Old Town Road. Upon arrival, an adult male identified as, TIMOTHY ROSHUN SMITH 22, of Birmingham, was being treated by the VHFD for a gunshot wound to his chest. A female juvenile was also treated by VHFD for a gunshot wound to the leg. Both victims were transported to area hospitals for treatment. TIMOTHY SMITH passed away on 04/15/2019 as a result of the injuries.
The investigation has determined that a firearm located in a backpack/diaper bag accidentally went off striking both victims. This was a tragic accident and condolences from the VHPD and VHFD go out to the family involved.
The juvenile victim is expected to make a full recovery.
UPDATE 4/16/19: According to the Jefferson County Coroner, Timothy Roshun Smith Jr. age 22 of Birmingham was pronounced dead Monday, April 15 at UAB Hospital. Smith Jr. was the father of the child injured in the alleged accidental shooting.
UPDATE (4:19 p.m.) Vestavia Hills Police Department said one round was accidentally fired from a gun inside a car. Investigators said it appears the shot was fired while the adult was changing the child’s diaper and the gun was in proximity. The child was shot in the leg and has non-life threatening injuries. The adult male was shot in the upper body and is in serious condition.
Police are talking to witnesses and collecting evidence.
It’s unclear whether there will be any charges filed.
UPDATE (3:44 p.m.) Ryan Farrell with the Vestavia Hills Police Department said police responded to reports of multiple gunshot-wound victims around 2:56 p.m. at the Chuck E. Cheese’s on Montgomery Highway.
An adult male with potentially life-threatening injuries was transported to UAB Hospital. A pediatric female with a gunshot wound was transported to Children’s Hospital in “stable condition at the time,” according to police.
No word yet on the search for a suspect.
