BIRMINGHAM, Ala. (WIAT) — UPDATE: Detectives obtained a warrant for capital murder and arrested Samuel Wiggins IV, 26, of Birmingham, on the scene. He is currently in the custody of Jefferson County Jail with no bond.

ORIGINAL: A man was found fatally shot and slumped over the wheel of a vehicle at a Birmingham apartment complex Saturday afternoon.

According to Birmingham Police Department public information Truman Fitzgerald, at around 4:10 p.m., officers were dispatched to an unresponsive person in a vehicle in the 1000 block of Penthouse Drive. The Mountainside Apartments are located in that block.

At the scene, officers observed Thomas Bostany, 29, of Birmingham, in a vehicle slumped over the wheel. Upon further investigation, officers determined he had been shot. Birmingham Fire and Rescue personnel arrived on the scene and pronounced him dead.

Fitzgerald said details are limited, though he noted the man was found within a large apartment complex. There is no suspect in custody.
