BIRMINGHAM, Ala. (WIAT) — The capital murder charges against Jonathan Wayne Talley, 40, and Misty Lynn Wright, 24, were dismissed without prejudice Thursday morning.

Misty Lynn Wright and her boyfriend, Johnathon Wayne Talley, had been charged with capital murder for the beating death of Wright’s 3-year-old daughter, Jettie Adams. Wright and Talley can be recharged if new evidence is found to incriminate them.

Wright is charged with aggravated child abuse. Talley was served a warrant for aggravated child abuse and is still in custody on a $1 million bond.

According to court documents, a witness has come forward with information that implicates a different individual in the death of the 3-year-old.
