Family of man killed in officer-involved shooting speaks out

HOMEWOOD, Ala. (WIAT) -- The family of John Payne spoke to CBS 42 about the fatal shooting that claimed the life of their family member.

The shooting happened on October 12, 2017. Payne was killed in the AllSouth Appliance parking lot off of Lakeshore Parkway after an alleged altercation with police. According to Payne's family, he was there around 1 a.m. fixing a flat tire for an employee. Payne owned a cleaning business and was finishing up work and getting ready to head home.

The autopsy report shows that fourteen bullets were found inside Payne's body. In a press conference last year, Homewood Police said the shooting was justified because Payne became combative with officers.The family, however, disagrees, certainly after learning that Payne was shot over 19 times.

Now, six months removed from when the shooting took place, Payne's family is looking for answers from investigators. They say law enforcement has been less than forthcoming about the investigation and they don't want Payne's case swept under the rug.

Jefferson County District Attorney, Mike Anderton tells CBS 42 that he is looking to bring this case to a close within the next week. He also says he has plans to speak with the family and their attorney, Richard Rice, in the coming days.
