Public Safety Committee Chairman Johnathan Austin says it's not the council's place to legislate morality and they can't take action based on suspicion.
"We'll, obviously we have to look at the tenants. The law that gives us the ability to legally revoke a business license, and there are several things, but one of them is if the business is a public nuisance and that obviously is something that we will be considering on Tuesday as we hear all the information on this establishment and then see what, what comes of it," said Austin. "But until we, until we have that information before us it would be premature for me or any other council member to make a decision as to how we are going to vote on Tuesday."
The council is also set to vote on a resolution concerning a controversial billboard that's causing quite a stir in East Birmingham.
The resolution would ask the owner of the billboard or the company - arrangementfinders.com- to take down an ad for a website that encourages young women to find a job and date a sugar daddy- through the site.
A petition asking elected leaders to remove the billboard now has more than 1300 signatures according to change.org. The Jefferson County Commission already passed a non-binding resolution to ask the company to remove the sign. That commission resolution does not have any authority to order the billboard to be taken down.
The city council resolution is also basically a statement of disapproval with no teeth. Even if it passes the company would not have to take down the billboard. A spokesperson for arrangementfinders.com previously told CBS 42 that the company had no intention of taking down the ad.
