BIRMINGHAM, Ala (WIAT) A federal court announced Monday that HB 56, the Alabama immigration law, has been temporarily placed on hold.
The law was scheduled to go into effect on Sept. 1. The temporary hold was ordered to give the court sufficient time to issue a decision on motions filed in three consolidated lawsuits to block the law, pending a ruling on the motions. The court’s temporary order does not reflect any view about the substance of the motions.
The hold will remain in place until Sept. 29 at the latest, and the court is expected to publish its decision on the three pending motions by then. The motions were filed by a coalition of civil rights groups, the United States of America, and bishops of the Episcopal, Catholic and Methodist churches in Alabama.

MONTGOMERY—Governor Robert Bentley released the following statement regarding Judge Sharon Lovelace Blackburn’s decision today in the illegal immigration lawsuit.
“I look forward to the Judge ruling on the merits. We have long needed a tough law against illegal immigration in this state, and we now have one. I will continue to fight at every turn to defend this law against any and all challenges.”

MONTGOMERY – August 29, 2011 – Alabama’s legislative leadership today applauded U.S. District Judge Sharon Lovelace Blackburn, Chief Judge of Alabama’s Northern District, for taking more time to examine efforts to block the state’s recently-enacted illegal immigration law by the Justice Department, American Civil Liberties Union, Southern Poverty Law Center and others by issuing a temporary injunction for 30 days.
The judge’s order specifically noted that it is in no way addressing the merits of the motions.
Senate President Pro Tem Del Marsh (R-Anniston) commended Judge Blackburn for taking more time to review the law.
“Judge Blackburn clearly understands the complexity of this issue and we are encouraged by her willingness to carefully examine all aspects of the case prior to ruling. We also appreciate Attorney General Luther Strange’s commitment to upholding state law and applaud his leadership in this case.”
House Speaker Mike Hubbard (R-Auburn) also applauded the judge’s deliberate approach to reviewing this law.
“I’m pleased Alabama is one step closer to having a law that addresses this growing problem. This is not an easy issue to adjudicate and I appreciate Judge Blackburn’s willingness to take the appropriate time to review the law. I am also grateful for the dedication of Attorney General Luther Strange and his team for their tireless efforts in this case to defend state law.”
Montgomery – Alabama House Majority Leader Micky Hammon (R – Decatur) on Monday released the following statement in reaction to Federal Judge Sharon Blackburn’s decision to issue a temporary stay in the first-round of a multi-plaintiff lawsuit seeking to have the state’s statute combating illegal immigration ruled unconstitutional.
Hammon, who served as the sponsor of the statute, which was approved overwhelmingly by the Legislature during its 2011 regular session and considered among the toughest of its kind in the nation, said:
“Judge Blackburn should be praised for the thought, consideration and due diligence she is putting into this ruling. With thousands of pages of briefs, responses and exhibits filed in this lawsuit, it is understandable that she desires more time to make her ruling. We can only wish that more federal judges were as thoughtful and deliberate.
Attorney General Luther Strange understands the severity of this issue, and he has our thanks for his determined effort to uphold Alabama’s immigration statute.
We must remember that today’s ruling is simply the first round in what promises to be a long judicial fight over Alabama’s right to protect its borders. To put it in sports terms, it is the first half-inning of the first game of a seven-game World Series.”
Birmingham, Al - Chairman Armistead released the following statement regarding Judge Sharon Blackburn's decision to issue a temporary injunction regarding the illegal immigration law.
"While I would rather have seen the new law approved and become effective on its legal due date of Sept. 1, I am hopeful that Judge Blackburn's decision to take 30 days to examine the constitutional issues will end up serving the people of Alabama well. The bill was carefully crafted by legal experts on this issue and we are hopeful it will withstand this legal test. I am heartened by both Governor Bentley's and Attorney General Strange's tireless support and defense of the law."
