The Dollars and Sense of Divorce

BIRMINGHAM, Ala. (WIAT) - It is a sad fact of bad economic times: troubled marriages pushed to the breaking point because of money issues. Last year there were more than 21,000 divorces in Alabama. In Jefferson County, the number of filings is expected to top 3,000 this year which is more than the previous year. Domestic Court Presiding Judge Suzanne Childers says they are seeing foreclosures and bankruptcies as couples struggle.

 

Defense attorneys say couples are changing how they approach divorce with less bitter fighting to save money. Mediation can cut court and attorney fees. The fight over the family home is also changing. “Used to be they came in arguing who could keep the house. Everybody wanted the house. Now they fight over who has to keep the house,” says divorce attorney Sam Kok. Some couples are forced do to a short sale or live together until the house is sold. Health insurance is another big concern for the ex-spouse who does not work.

 

While an attorney costs money, it could save in the long run. You may also need a financial planner to help with tax and retirement planning.  "Each party will need new wills and power of attorney. You should be careful reviewing insurance contracts and retirement plans,” advises financial planner Woodard Peay.

 

Couples should remember their standard of living will likely drop after divorce as maintaining two households is more expensive than one.
