Van der Sloot sues over extradition

Birmingham, Ala (WIAT)  Joran van der Sloot wants $10 million dollars for what he calls human rights violations when he was extradited from Chile to Peru a year and a half ago.

The lawsuit comes just days after a Peruvian court gave van der Sloot a January 6 trial date on charges he murdered a 21 year old Peruvian student he met at a poker tournament.

The Dutchman has admitted he killed Stephany Flores.  He says it was in a fit of rage after she found material relating to vanished Mountain Brook teen Natalee Holloway on his laptop. Peruvian investigators say that the Holloway material was accessed the day before Flores died and that the motive was robbery.

Flores' corpse was found in van der Sloot's Lima hotel room five years to the day of Natalee's disappearance on a graduation trip to Aruba.  She was last seen alive leaving a bar with van der Sloot.

The grisly discovery in the Lima hotel room set off a search for van der Sloot that culminated in his arrest in neighboring Chile and his return to Peru.

According to the Lima daily El Commercio van der Sloot claims there was pressure from the then President of the Republic Alan García Pérez" to the Chilean government to extradite the Dutchman, who was arrested in Arica shortly after the murder.

Also named in the lawsuit are former interior minister Octavio Salazarm  former Police Generala Cesar Guardia and Miguel Hidalgo , and the murdered girl's father, Ricardo Flores.

Van der Sloot has previously raised the same issues of due process and police irregularities....claims that have been dismissed by Peruvian courts.   This time he filed his claim with the Inter-American Commission on Human Rights.

It's not exactly a "lawsuit" anyway. It's a petition to the "inter-American Commission on Human Rights"... the IACHR. That's an agency headquartered in Washington DC to ensure human rights are not violated in charter members of the "inter-American Court of Human Rights". Inter-American means North, South and central america and it is only "binding" to charter members. Peru and Chile are both charter members. Surprisingly, the US is NOT. ********* Anyway, the IACHR will review the petition. If they agree that Jorans "humans rights" were violated, which is highly doubtful given the circumstances, then they MAY refer the case to the court. Only after they attempt resolution. If no resolution is reached and IF the court agrees to hear the case, and IF they find Joran's human rights were violated, the court may award $ or they may just demand "Chile and Peru apologize to Joran for his extradition". But that is doubtful given that 2 of the 7 judges residing in the court are from Peru and Chile and given the dead body of Stephany Flores and given the evidence against Joran. ********* Nope. I don't expect it to go any further than a petition to the commission and a ruling by the commission against Joran.

Don't worry bamagrl. Joran doesn't stand a chance of being awarded $10mm from anyone. This is like a "hail Mary" pass thrown by an ex 2nd string quarterback to a parking lot attendant the day after the game was lost. Instead of awarding a "win", the "quarterback" should be arrested for trespassing. ******** Anyway... Joran was caught red handed after murdering a woman. He's going to jail for a long long time and he knows it. He's trying everything he can to avoid that or at least to have some chance at life after he gets out. What does he have to lose anyway?

All of this with this Monster has gone on way to long. If he were in America this fool would have been found tried and probably killed in Prison. I'am a Mt. Brook resident , the neighborhood where Natalie H. resided in. I don't know the family, but my Heart still hurts for her family and friends. Enough is Enough !!Bring this MONSTER to Justice and give him what he deserves. We know this will never happen, Because Justice doesn't fit the crime. All Thou I believe an Eye For An Eye!

I wonder if Peru courts can sanction attorneys for filing meritless lawsuits like we have here in the US?

last ditch effort by JVDS and his public defender to avoid 30yrs in a Peruvian hole. Too bad for Joran. It won't work. In fact it may backfire.
