Park In Your Yard, Pay A Fine

BIRMINGHAM,AL (WIAT)- Parking your car in your front yard, or on the sidewalk, has just become a crime in one area city.

The Birmingham City Council passed a new parking ordinance Tuesday morning. From now on, parking away from the pavement could cost you a fine.

A set of tire tracks leads up to a blue truck parked in the front yard of a man who feels a new law is violating his rights.

"We don't own anything anymore. If the city can come in, City Council comes and says, 'you cannot do this, you cannot do that on your property, because this is just the beginning,'" said John W. Ford, Sr.

Ford is fuming over a new ordinance that prohibits him from parking in his own grass.

People say there's simply not enough room to park in the driveway, so they park in the yard instead.

"Especially on a busy street, they pull their car off the street, some of them pull it off the sidewalk or the curb, where it wouldn't be sideswiped," said Ford.

But, at the same time, some folks say the law is necessary....because a parked car is not just a personal matter.

"It brings down the value of the property and I wouldn't want to come in a neighborhood when there's nothing, but a lot of cars parked and there's no grass and no progress in the neighborhood," said Vivian Starks. 

For now, those who insist on breaking this law can expect a $50 fine.

"I'm hoping Birmingham just enforces it, that's all. If they enforce it, we'll be okay," said Starks.

Just got a ticket yesterday...(in Forest Park). I park in my front yard because the police department is COMPLETELY incompetent in enforcing the speed limit on my street. I have had 3 cars side-swiped, and one totalled...ALL hit-and-runs. At all hours of the night you can hear people screaming down the street at 50-60 mph (speed limit is 25 mph). There have been countless petitions passed around by my neighborhood association BEGGING the police to do something about the traffic, but they refuse. They are COMPLETELY worthless.

Voting is useless, but one can choose not to comply... If no one complies, the council will end up looking pretty stupid.... ;)

In response to flgrl's comment, I would like to say that before I wrote the story, I looked up the meaning of "crime." In some cases, the definition was very general, citing crime as the "breach of rules or laws," "an act punishable by law," and "unlawful activity." In other cases, as you pointed out, it described a more severe wrongdoing, a serious offense. But after consulting with several people, many agreed that "crime" could be used in this context, showing that you could be punished by violating this new law.

I have been trying to tell Americans for years that they do not own the land that they think belongs to them. It all belongs to the queen. I know that it sounds crazy, but the history is written down and available to read. America is and always has been a British colony.

Ummm, how's the city's finances going there? This could be a way to make money. I think its nuts. You get a ticket if your car sits on the street for more than 30 days without moving, then you move the car to your yard, and you get a ticket for parking on YOUR OWN PROPERTY????How about filling in the entire front yard with concrete, make it an entire parking lot? I think this town's law makers have gone over the limit of ....ya just can't fix stupid!!!

Good grief!! This is ridiculous. I can see if it looked like a junk yard, but it is that person's PRIVATE property.

I can't wait until Vivian (mentioned in the article) decides to plant roses in her yard and someone on the council decides that rose thorns present a danger to local kids and therefore can't be allowed. I wonder how she would view having her right to do something so simple on HER OWN PROPERTY now be in violation of a city council ruling and have to pay a fine if she did it anyway.....? God save us from ourselves.

I'd just like to point out that violation of this city ordinance is not a "crime." It would not result in criminal prosecution or charges; it is a civil infraction (like a parking ticket). There's a big difference and, as a news station, you should take the time to do some research so that you're not feeding your readers incorrect and inflammatory statements. Also, whether Birminghamd residents realize it or not, if you live inside the city limits, you already live under a host of similar ordinances. There are noise ordinances, ordinances about grass height, junk in yards, etc. So, this is nothing new and, if you choose to buy/live inside the city limits, you're on the hook. The moral of the story is: if you don't like it, vote for a mayor/city council who won't pass ordinances restricting your rights as property owners OR move out of the city limits. People get mad and say they're outraged but then they sit back and never do anything about it. The only way to proptect your rights is to take an active role in your city's government/politics. Ranting and raving on a message board will most likely accomplish nothing. If you want to protect your rights as property owners you have to get involved. I bet that many of the people who wanted this ordinance passed were present at the city council meetings where it was discussed and voted on; were you there? I didn't think so.

who in the HELL do these city officials think they are. They have no right what so ever to tell people who own the property what to do with it....period. I live in the central Florida and I am outraged by this new ordinance...I for one who not let them tell me what to do in my own land, if I spend my hard earned money for the property that my family and I live on, then sure as hell will drive on it if I want to.....
