EUTAW, Ala. (WIAT) - Greenetrack supporters have finally won a battle in Alabama's bingo war. Jefferson County Houston Brown made a ruling on Wednesday approving the gaming facility's motion for the return of seized property. Earlier this summer, those machines were confiscated by the state in a raid, however, the judge has now ruled there was no probable cause for those raids to take place. Judge Brown also had harsh words for the state within his ruling. Brown alledged that the state presented false, misleading, and information with a reckless disregard for the truth in it's testimony. Futher, Brown says that once those parts were removed from the testimony, there was nothing left to establish the probable cause needed for the warrant in the first place. Brown also questions the state's gambling expert and his own role as judge over the case, asking if the state went "judge shopping" to avoid involving Greene County's two circuit court judges.
The Attorney General's office has responded to the ruling saying that it "strongly disagrees" with the ruling and characterization of the state and will be seeking an appeal with the Alabama Supreme Court. In the same prepared responce, Luther Strange also mentions he will seek a stay. That stay could prevent the machines from returning to Greenetrack within the allotted 10 days.
