The 2nd Amendment protects the rights of citizens to bear arms.  One Alabama organization is trying to make sure they get the full extent of those rights.

Alabama Open Carry (ALOC) is a grassroots organization dedicated to protecting and fighting for the rights of those who choose to wear their firearms in public.

"A lot of people, as soon as they see a firearm in the open they either, one, assume your a law enforcement officer, or that it's illegal, that you can't do that," says Jason Jones, president of ALOC.  He points to legal precedence in support of the right for citizens to open carry.  "Since the 1800's there have been multiple cases to prove that alabama open carry, or, carrying a firearm openly on your hip is totally legal in Alabama."

Many people do not know the laws regarding open carry.  ALOC fights for it's members that continue to run into legal problems over their choice.  "We can give them information about how to handle it.  We can give them information from others who have gone through the same situations," says Tony Shifflet, a member of ALOC.

In the wake of the Tuscon shooting, many second amendment activists around the country are saying that if citizens were allowed to open carry, incidences like this could be prevented.  "The average citizen cannot depend on law enforcement for self protection.  Law enforcement is here to protect society as a whole, not to protect the individual citizen, you have to do that on your own," says Shifflet

ALOC is pushing for new state legislation to try and make open carry an easier and less hassling experience.  They have drafted a set of amendments called "The Self Defense Protection Act of 2011."  "It's a set of laws to further strengthen our second amendment laws in the state of Alabama.  We have a petition going right now that we actually have over 1,200 signatures supporting this legislation," says Jones.

The organization is trying to get the bill on the agenda for the current legislative session.

The 2nd Amendment and Section 26 of the AL Constitution protect the right to bear arms. Open Carry has been legal in AL since before it became a state and has been a protected right in every AL constitution. The AL Supreme Court ruled in 1840 that the state leislature cannot inhibit the citizen from bearing arms openly and this ruling has never been overturned. Currently, there is no law banning the open carry of firearms in the AL Criminal Code. Open Carry in some form is currently legal in 43 states. In AL no license is requireded to carry openly and the only restrictions are for building with "No Firearms" signs and public demonstrations. If any citizen is interested in protecting their right to keep and bear arms, we ask them to check out the ALOC website at aloc.info, join our group and sign the online petition. Alabama Open Carry is a grassroots organization dedicated to instructing citizens and law enforcement about the lawful carry of firearms in public. The benefits of open carry is that it doesn't limit you to carrying smaller, more concealable firearms. You don't have to worry about your firearm becoming uncovered or "printing" through your clothes. You have easier access should you need your gun as opposed to trying to get clothes or coats out of the way and open carry has been seen as a deterrent to criminal activity. Unfortunately, as the law is currently written, you need a concealed license to carry a pistol in a vehicle (which we are working to change). But unlicensed open carry is legal while on foot. If you have any questions about the gun laws in AL and what you can or can't do legally, please check out the website at aloc.info and join today. We have local meetings around the state where citizens get together with like-minded people to discuss ideas and concerns dealing with firearms laws, new places to shoot and self-defense strategies and techniques. The meetings are open to the public and locations and times are on available on the site.
